AB 1642 and AB 1795 Take Effect January 1 — Know Your Rights and Insurance Deadlines
EFRU-sponsored AB 1642 and companion insurance law AB 1795 take effect January 1, 2027, establishing California's first statewide framework linking science-based wildfire contamination testing, remediation, and clearance with insurance protections, including necessary testing, restoration, and Additional Living Expense (ALE) coverage where applicable. Important: Insurance lawsuit deadlines may begin as early as January 7, 2027, for some survivors. Deadlines vary by individual claim, and the new laws do not automatically extend them. Consult an attorney about your circumstances.
StandingHomes.la provides guidance for Eaton and Palisades fire survivors on identifying hidden contamination, requesting appropriate testing and remediation, and protecting insurance rights—even if their homes have already been cleaned.
To help survivors navigate these issues, Every Fire Survivor's Network is offering its free "Beat the Clock" webinar series, with upcoming sessions on October 29: Smoke Damage; November 5: FAIR Plan; and November 12: Lawyers Q&A.
EFRU continues advocating for effective implementation across standing homes, schools, rental housing, and insurance restoration.
