AB 1795 Advances to Senate Floor Despite Limits on Testing
AB 1795, the Smoke Damage Recovery Act, also passed Senate Appropriations 5–0 on August 13 and is headed to the Senate Floor. This is an insurance bill that, as currently written, limits access to science-based testing.
EFRU continues to press for the protections the author of AB 1795, Assemblymember Gipson, promised during the Assembly debate — including a rebuttable presumption that contamination found after a wildfire was caused by the wildfire, rigorous scientific health-and-safety standards, and a more precisely defined smoke and ash impact zone that protects all affected policyholders. EFRU also continues to oppose any new contaminant-damage sublimit that could leave wildfire survivors without enough insurance coverage to pay for necessary testing and recovery. We will continue tracking both AB 1642 and AB 1795 closely as they move toward Senate Floor votes.
