CA Signs New Home-Insurance Nonrenewal Protections

Governor Newsom signed SB 1301, Senator Ben Allen’s Insurance Policy Nonrenewal Reform, sponsored by Consumer Watchdog and EFSN, creating new residential-property-insurance notice and disclosure requirements. SB 1301, Residential Property Insurance: Nonrenewals, sponsored by Consumer Watchdog and EFSN, creates new notice and disclosure requirements for homeowners facing nonrenewal. Beginning Jan. 1, 2028, most nonrenewal notices must be provided at least 90 days before policy expiration; when an insurer identifies a remediable condition, the law generally requires earlier notice and an opportunity to cure. SB 1301 was also a priority of Dena Rise Up’s survivor-led Sacramento Advocacy Days in May and August 2026, with EFRU participating in the broader coalition effort.

Newsom also signed Senator Allen’s SB 1209, the Insurance Examination Compliance and Accountability Act, sponsored by Insurance Commissioner Ricardo Lara. The law strengthens the Department of Insurance’s ability to require insurers to correct violations identified through financial and market-conduct examinations, establishing compliance deadlines and authorizing penalties of up to $20,000 per violation when corrective actions are not completed. SB 1209 takes effect Jan. 1, 2027.
